A Yola high court presided by Justice Nathan Musa has discharged and acquitted former commissioner of finance Sanda Lamurde and former state chairman of PDP, Abdurrahman Bobboi of graft charges against them.
Musa in his ruling chided the Economic and Financial Crimes Commission (EFCC) for being the complainant and the prosecutor of persons and groups.
The anti graft agency was faulted by Justice Nathan Musa, while delivering judgement today in a case of Federal government against Hon Jonathan Sanda Lamurade and Abdurrahman Bobboi.
Lamurde, a former commissioner of finance during Bala James Nggilari administration was discharged and acquitted for want of evidence.
EFCC had preferred a 21 count charge of conspiracy, breach of trust and diverting funds to the tune on N700m against the former commissioner of Finance.
The state Chief Judge, Justice Nathan Musa in his judgement said the prosecution has failed to prove the case beyond reasonable doubt.
In the same vain, Hon. Justice Nathan, also discharged and acquitted, Abdulrahaman Bobboi, erstwhile Protocol Officer to former Governor Bala James Ngillari, and one time state Chairman of the Peoples Democratic Party in Adamawa State for allegedly diverting the sum of N8.140 million for want of evidence.
The trial Judge also faulted the process where the Anti Graft agency is the complainant and the prosecutor at the same time.
The EFCC in its 3 count charges before the court, alleged that Bobboi, who is the Political Adviser to Governor Fintiri, diverted the amount of money which was meant to transport food items to Internally Displaced Persons.
