NJC denies giving govs’ mandate to appoint, promote judges

The National Judicial Council (NJC) has taken swift action to debunk a misleading letter that falsely claimed the Council had relinquished its constitutional authority over the appointment and promotion of judges to state governors.

The NJC categorically stated that the letter, purportedly signed by the Chief Justice of Nigeria (CJN), Justice Olukayode Ariwoola, and addressed to the Chief Judge of Kebbi State, did not originate from the Council or the CJN.

In a statement released by NJC’s Director of Information, Soji Oye, on Sunday, the Council refuted the false claims made in the fake letter and urged the public to disregard its contents.

The fabricated letter, titled ‘Order of Seniority of Judges of the High Court of Kebbi State and Recommendation of Justice Umar Abubakar as the Substantive Chief Judge of Kebbi State,’ made the baseless assertion that the Governor possessed the authority to determine the seniority of judges in accordance with the Kebbi State law of 1996.

The letter further stated that the National Judicial Council lacked the power to challenge or overturn the Governor’s decision.

These inaccurate claims sought to undermine the NJC’s established role in judicial appointments and promotions.

NJC’s Denial and Clarification

The NJC promptly issued a statement dismissing the content of the fake letter as entirely false. It clarified that neither the Council nor the Chief Justice of Nigeria had issued such a letter.

The NJC reiterated its commitment to upholding its statutory powers and responsibilities, including overseeing the appointments and promotions of judges.

The Council affirmed that the information contained in the fabricated letter had no factual basis and encouraged the public to treat the letter with skepticism.

Action Taken by NJC

In response to this alarming attempt to spread misinformation, the NJC has not only refuted the claims but also taken further steps.

The Council has reported the incident to relevant security agencies, initiating an investigation to apprehend those responsible for orchestrating the dissemination of false information.
