~ Vows to challenge action in court
The opposition All Progressives Congress (APC) in Adamawa State has in a strong worded statement condemned what it called the undemocratic sacking of a member representing Michika state constituency, Joseph Ayuba who recently defected to APC from the ruling People’s Democratic Party (PDP).
Thirteen out of the twenty five members of the assembly have during Wednesday’s plenary superintended by the speaker, Aminu Iya Abbas declared the position of the lawmaker vacant citing section 109 1 (G) of the constitution.
Condemning the action of the assembly, APC in a statement signed by its publicity secretary, Mohammed Abdullahi said the action is reprehensible and a fundamental breach of the spirit and letters of constitutional democracy.
He noted that the action of the speaker in allowing the heist to take place in the hallowed chambers of the assembly constitute a great sacrilege and desecration of the revered institution.
“The Speaker of the Adamawa State House of Assembly is under oath to do justice to all manner of people and not to allow his personal interest to interfere with his official conduct but his action has proved otherwise.
“It’s on record that Hon. Musa Umar Bororo announced his defection to PDP from APC on the floor of the house, the speaker warmly welcome him and saw no offence in his action.
“Hon. Joseph Ayuba Kwada for strategic reasons didn’t announce his defection on the floor of house but the speaker based on personal interest and that of the Adamawa State Governor hurriedly declared his seat vacant in a commando style.
“As a Party we therefore strongly condemn such clueless and selective justice in it’s entirety.
“As a law abiding Political Party, we are aware that it’s only the court that has inherent powers to declare a seat vacant
Consequently, we have resolved to challenge the following actions of the speaker in a court of competent jurisdiction:
“1. The procedure followed in reconvening the house which has been on recess.
“2. Allowing personal interest to interfere with official conduct.
“3. The glaring injustice and partisanship in declaring Hon. Joseph Ayuba Kwada’s seat vacant.
“By this statement the legal Adviser of our Great Party has been mandated to commence the legal action and equally ask the court to declare Hon. Musa Umar Bororo’s seat vacant while we continue to pursue other political solutions as a Party,” Abdullahi said.
